Welcome to the Lucid Aero website (the “Site”). These Terms of Service (“Terms”) govern your access to and use of the Site and the purchase and use of Lucid Aero products and services. By accessing the Site or placing an order, you agree to be bound by these Terms.

Lucid Aero (“Lucid Aero,” “we,” “us,” or “our”) designs and sells pneumatic polishing and finishing equipment intended for professional and industrial use.

2. Eligibility and Intended Use
Lucid Aero products are intended for use by trained adults in professional, industrial, or commercial environments. By purchasing or using our products, you represent that you are at least 18 years of age and possess the knowledge, training, and experience required to safely operate pneumatic tools.
Products are not intended for consumer, household, or hobbyist use unless explicitly stated.
3. Orders and Acceptance
All orders placed through the Site are subject to acceptance by Lucid Aero. We reserve the right to refuse, cancel, or limit any order at our discretion, including for suspected fraud, export restrictions, pricing errors, or inventory limitations.
Order confirmation does not constitute acceptance until the product has shipped.
4. Pricing, Taxes, and Billing Errors
All prices are listed in U.S. Dollars unless otherwise stated. Prices do not include applicable taxes, duties, customs fees, or shipping charges unless explicitly noted.
Lucid Aero reserves the right to correct pricing, billing, or processing errors, even after an order has been submitted or confirmed. If an error affects your order, we may adjust the charge or cancel the order and issue a refund.
5. Payments and Authorization
Payments are processed through a third-party payment processor, including Stripe. By submitting payment information, you authorize Lucid Aero and its payment processors to charge the provided payment method for all amounts associated with your order, including applicable taxes, shipping, and fees.
You represent that you are authorized to use the payment method provided.
6. Shipping and Delivery
Shipping dates are estimates only and are not guaranteed. Risk of loss and title pass to the buyer upon delivery to the carrier, unless otherwise required by applicable law.
You are responsible for ensuring accurate shipping information and for compliance with all import, customs, and local regulations.
7. Returns and Refunds
All purchases are subject to Lucid Aero’s Return and Refund Policy, which is incorporated into these Terms by reference. Eligibility for returns, refunds, restocking fees, and exclusions are governed by that policy.
Lucid Aero does not accept returns of used, damaged, or modified tools unless required by law.
8. Export Controls and Sanctions Compliance
Lucid Aero products may be subject to U.S. and international export control laws and regulations, including those administered by the U.S. Department of Commerce and the Office of Foreign Assets Control (OFAC).
You agree not to export, re-export, transfer, or use any product in violation of applicable export laws, trade sanctions, or embargoes. You represent that you are not located in, under the control of, or a national or resident of any prohibited country or restricted party list.
9. Product Use, Safety, and Assumption of Risk
Pneumatic tools involve inherent risks, including serious injury or death if used improperly. You are solely responsible for: - Reading and following all safety instructions and documentation - Using appropriate personal protective equipment - Ensuring proper air supply, pressure regulation, and maintenance
To the fullest extent permitted by law, you assume all risks associated with the use, handling, and operation of Lucid Aero products.
10. Warranties and Disclaimers
EXCEPT AS EXPRESSLY STATED IN A WRITTEN WARRANTY PROVIDED WITH THE PRODUCT, LUCID AERO PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUCID AERO DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Some U.S. states do not allow limitations on implied warranties, so certain limitations may not apply to you.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LUCID AERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF USE, OR BUSINESS INTERRUPTION.
LUCID AERO’S TOTAL LIABILITY ARISING OUT OF OR RELATED TO ANY PRODUCT OR THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Lucid Aero, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses arising from your misuse of products, violation of these Terms, or violation of applicable laws.
13. Chargebacks and Dispute Resolution
You agree to contact Lucid Aero directly to attempt to resolve any billing, product, or service issues before initiating a chargeback or payment dispute.
Unauthorized or abusive chargebacks may result in account restrictions or refusal of future orders.
14. Digital Content and Documentation
Any manuals, videos, documentation, or digital content provided by Lucid Aero are provided for informational purposes only and may be updated or modified without notice.
15. Governing Law and Venue
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law principles.
Any legal action arising out of or relating to these Terms or the products shall be brought exclusively in the state or federal courts located within that state, and you consent to personal jurisdiction in those courts.
16. Changes to These Terms
Lucid Aero reserves the right to modify these Terms at any time. Updated Terms will be posted on the Site with a revised effective date. Continued use of the Site or products constitutes acceptance of the updated Terms.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with any policies referenced herein, constitute the entire agreement between you and Lucid Aero regarding the use of the Site and purchase of products.
